Catastrophic injury to a young adult - How to help

Course content 

Thomas was 4 years old when he developed encephalitis. It was not identified readily by the hospital that was treating him, and as a result he suffered a significant brain injury. Initially, he was able to attend mainstream education, but as he grew older, his mental and physical injuries became more pronounced. Thomas is now 17, he has a professional Deputy, his clinical negligence litigation settled last year, and we meet him and his family as they try and navigate the murky waters of transitioning into adulthood.

- Working with case managers and therapists
- Re ACC and the limits of Deputy decision making
- Buying and adapting property
- Family conflict, trauma and communication
- Social media
- Capacity to have sex
- DOLs

About SFE case study sessions

A leading expert will craft a case study which you will receive in advance of the session. They will go through the key issues with you as a group and then will use breakout sessions for you to discuss a particular question. Each group will be looking at a different question, so that there is no risk of hearing the same solution over and over again. NB: due to the sheer number of people who have booked on, we will now not be using breakout rooms, but will ensure that you have plenty of opportunity for discussion and interaction with the speaker. 

A week after the session, you will be sent a set of key learning points that you will be able to use in your day to day practice.


 

About the speaker

Holly Mieville-Hawkins

Holly is a Senior Associate Solicitor, and Head of Mental Capacity at Michelmores LLP. She is a passionate defender of the rights of people who lack the mental capacity to make decisions for themselves. Her work is her vocation and it is what gets her up each morning.  

The issues that she deals with range from appointing and removing deputies and attorneys, managing high value and often complex Deputyships, Re ACC issues, acting as a litigation friend, onshore and offshore matters where there are capacity issues, gifting, capacity to litigate, matters relating to the capacity to marry, purchasing and selling property, incapable trustee matters, and statutory wills. She also deals with concerns about financial abuse. 

She is a founding member of the practitioner group that established the Mediation in the Court of Protection pilot scheme, is Deputy Chair of the Mental Capacity Special Interest Group for STEP; a member of the South West Court of Protection Practitioners Association and a stakeholder at the Office of the Public Guardian.
She holds a full STEP diploma and is a Full Accredited member of Solicitors for the Elderly.
